End of Employer-Provided Insurance During the Legalization of Your Stay—What Should You Check?

The termination of employment does not automatically establish a single common date for all insurance and residency matters. The date of termination of employment, the expiration of eligibility for mandatory health insurance, the end of entitlement to benefits, and the start of coverage under a private medical insurance policy for a foreign national must be determined separately. These dates may vary. Therefore, before changing your source of coverage, it is advisable to collect documents from your employer, verify your information with ZUS, and review your policy along with the General Terms and Conditions. At the same time, you should confirm the requirements specific to your residence procedure. The following sequence helps organize the formalities but does not determine the individual status of a specific person.

Five dates that should not be confused with one another

The first date is last day of employment arising from a contract, agreement, notice of termination, or employment certificate. It serves as a starting point, but does not, in and of itself, cover all issues related to protection.

The second one is the date on which the right to insurance coverage ceases. For employees, the start and end dates of the health insurance obligation are linked to the deadlines specified in social insurance regulations. In a specific case, therefore, one must compare the basis of employment with the deregistration document, rather than relying solely on the common belief that „insurance ends when employment ends.”.

The third date pertains to the employer's actions. ZUS states that the deregistration must be submitted within 7 days of the termination of insurance coverage. The ZUS ZWUA form is used for this purpose. However, the deadline for submitting the document does not constitute an additional period of coverage. It is the deadline by which the payer must fulfill the reporting obligation.

The fourth date marks the end of the right to publicly funded benefits. For individuals covered by the provisions of Article 67, paragraphs 2–4, of the Health Care Benefits Act, this right generally expires 30 days after the health insurance requirement expires. This rule should not be automatically applied to everyone. It is necessary to verify the basis of the insurance coverage and the relevant documents. Nor is this the effective date of a private insurance policy.

The fifth is When a private insurer's liability begins. This is determined by the contract, the policy, the General Terms and Conditions, and the payment of the premium. Only by comparing all five dates can you determine whether there might be a gap in coverage between your current coverage and the KLC policy.

Documents After Termination of Employment

First, gather the documents that will help you establish the facts, rather than relying on your memory. The following will be useful:

  • document confirming the end of employment, such as an employment certificate or an agreement;
  • information regarding the date of deregistration and a copy or confirmation of the data submitted to ZUS ZWUA;
  • a document confirming previous enrollment in health insurance;
  • correspondence with the agency handling the residency case, particularly requests to submit additional documents;
  • the new policy, the General Terms and Conditions, and proof of premium payment.

If you need official confirmation of your registration, ZUS provides an online process for requesting a certificate. In the PUE/eZUS service catalog, select the service „Submission of an UWZ document.” This certificate can help you compare the data in the system with the documents you received from your employer.

Check to make sure that the first name, last name, identification number, and dates match on all documents. It's a good idea to clarify any discrepancies before submitting your residence permit documents, because a subsequent correction may require additional correspondence. However, the mere absence of a copy of the ZUS ZWUA form does not necessarily mean that the deregistration did not take place.

It’s helpful to plot the dates on a single timeline. On the left, mark the end of employment and the termination of status, followed by the date of deregistration; on the right, mark the end of entitlement to benefits and the start of the KLC policy. This way, You won't confuse the administrative deadline with the protection period.

How to Determine the Effective Date of a Private KLC Policy

Do not assume that purchasing a policy means coverage begins immediately. The Civil Code provides for a default rule: unless otherwise agreed, the insurer’s liability begins on the day following the conclusion of the contract, but not earlier than the day following payment of the premium or the first installment. The most important caveat is: The contract may specify the commencement of liability differently.

Before making a purchase or immediately after receiving the documents, check these four key elements:

  • the date and time when coverage begins as specified in the policy;
  • the terms for premium payment and the date the payment is posted;
  • insurance period and territorial coverage;
  • Post-incident responsibilities, including how to contact the emergency dispatch center.

It's not enough to just compare product names. KLC is not an automatic equivalent of employment-related protection. A private insurance policy has its own coverage, sum insured, exclusions, procedures, and limitations. It should be considered as separate coverage for events covered by the policy, including sudden illness, accident, necessary hospitalization, medical transport, or repatriation—exclusively within the limits specified in the specific policy and the General Terms and Conditions.

For example, the General Insurance Terms and Conditions (GITC) for the Compensa Cudzoziemiec product from 2026 stipulate that the insurance is valid only within Poland. These same GTC specify the obligation to pay the premium and, following an incident, require the insured to contact the Emergency Call Center to obtain a guarantee that the costs owed to the medical facility will be covered. These are terms and conditions for a specific product, rather than a universal rule that applies to all KLC policies. Before making a decision, you should review the current document and your own policy.

Insurance and the Ongoing Process of Legalizing Residency

A document accepted in one procedure may not be sufficient in another. The official description of the requirements for a temporary residence and work permit specifies statutory health insurance or confirmation from an insurer that it will cover medical expenses within Poland. However, this is a description a specific type of permit, rather than a rule that applies to every type of residence status.

After completing the work, determine the following separately:

  • what type of application or permit applies to your case;
  • what stage the proceedings are at;
  • Has the agency set a deadline for submitting the document?;
  • What period and scope should the insurance cover?;
  • Does a change in your employment status result in separate obligations in your situation?.

Do not determine your status on your own based solely on the date the contract was terminated.

There is no single deadline that applies to all situations. You should check the obligations following job loss based on the specific procedure and stage of the case. The safest approach is to refer your question to the content of the decision, instructions, or summons you received, as well as to the information provided by the relevant agency.

A private insurance policy does not automatically resolve residency issues. The insurance document and the residency requirement must be verified separately. If you do not have a current proof of coverage, see, What to Do If You Don't Have Insurance Linked to Your Residence Card.

Practical Steps to Follow

Following the correct sequence of steps reduces the risk of signing a contract with an incorrect start date or submitting a document to the authorities that does not comply with the applicable procedure.

  1. Confirm the date of termination of employment in a document from the employer.
  2. Request the deregistration information and verify that the correct termination date is listed.
  3. If necessary, request a certificate of health insurance enrollment through PUE/eZUS.
  4. Determine the appropriate residency procedure and read the current notices or instructions.
  5. In your KLC policy, check the effective date of coverage, the coverage period, the coverage area, the scope of coverage, the exclusions, and the procedure to follow after an incident.
  6. Compare dates before paying, especially if you want to avoid a gap in coverage.
  7. Keep your policy, the General Terms and Conditions, and the payment confirmation in a single file or folder.

A realistic example: An employment contract ends on Friday, but the purchaser selects a start date on the policy that falls a few days later. You cannot assume that a policy purchased over the weekend will cover earlier dates. You must read the start date from the policy, check the payment terms, and compare them with the dates related to the previous coverage. Gaps must not be filled in with guesswork.

Frequently Asked Questions

Does the protection provided by an employer always end on the last day of employment?

You should not assume this without checking the basis for insurance coverage and the relevant documents. The end of employment, the termination of eligibility for insurance, and the end of entitlement to benefits are separate events. The relevant regulations and the specific individual’s circumstances are what determine the outcome, not the colloquial term „employee insurance” itself.

Does the 7-day cancellation period mean an additional 7 days of coverage?

No. ZUS specifies this period as the deadline for reporting deregistration after the basis for insurance coverage has ceased. The reporting deadline does not, in and of itself, extend coverage.

Does every person still have 30 days of eligibility for benefits?

This rule cannot be automatically applied to every situation. The law limits it to specific individuals covered by mandatory health insurance and their registered family members. It is necessary to first determine on what basis a given person was registered.

Does a private KLC policy take effect on the date of purchase?

Not always. The effective date of coverage is determined by the contract, the policy, the General Terms and Conditions, and the rules governing premium payments. The rule in the Civil Code applies only if nothing else has been agreed upon. Check the specific date on the policy rather than assuming it is the same as the date the form was filled out.

Does the KLC policy replace the previous coverage with the same scope?

There is no basis for assuming full equivalence. These are different types of coverage, with different rules, scopes, and procedures. Compare the policy documents, not just the names of the insurance policies.

Is a KLC policy sufficient for every residency case?

This cannot be guaranteed. The requirements depend on the type of proceeding, the stage of the case, and the content of the summons. Check the requirements of the relevant authority and the terms of the policy separately. The final assessment of the document is up to the authority handling the case.
